Tutuklanan bir ki\u015finin h\u00e2l\u00e2 bu kanallar \u00fczerinden topluma mesaj vermeye devam etmesi, tutuklaman\u0131n amac\u0131n\u0131 bo\u015fa \u00e7\u0131kar\u0131r, hatta hukuk d\u00fczenini alenen istismar etmek anlam\u0131na gelir.<\/p>\n\n\n\n<p>T\u00fcrk hukuk d\u00fczeni, temel haklar\u0131 g\u00fcvence alt\u0131na al\u0131rken bu haklar\u0131n s\u0131n\u0131rs\u0131z olmad\u0131\u011f\u0131n\u0131 da a\u00e7\u0131k\u00e7a ortaya koymu\u015ftur. Anayasa\u2019n\u0131n 13. maddesi, hak ve \u00f6zg\u00fcrl\u00fcklerin \u201cdemokratik toplum d\u00fczeninin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine\u201d uygun bi\u00e7imde s\u0131n\u0131rland\u0131r\u0131labilece\u011fini h\u00fckme ba\u011flar. Ayn\u0131 zamanda 19. madde, tutuklaman\u0131n yarg\u0131 karar\u0131yla m\u00fcmk\u00fcn olabilece\u011fini d\u00fczenlerken, Ceza Muhakemesi Kanunu\u2019nun 100. maddesi, tutuklaman\u0131n gerek\u00e7elerini a\u00e7\u0131k\u00e7a sayar: ka\u00e7ma \u015f\u00fcphesinin varl\u0131\u011f\u0131, delilleri karartma ihtimali ve su\u00e7un a\u011f\u0131rl\u0131\u011f\u0131. Ne var ki, kamu g\u00fcc\u00fcn\u00fc kullanm\u0131\u015f, halk\u0131 temsil etmi\u015f bir \u015fahsiyetin sosyal medya \u00fczerinden kitleleri y\u00f6nlendirme imk\u00e2n\u0131, sadece delil karartma veya ka\u00e7ma \u015f\u00fcphesinden ibaret de\u011fil; do\u011frudan demokratik d\u00fczenin i\u015fleyi\u015fine y\u00f6nelik bir tehdit olarak de\u011ferlendirilmelidir.<\/p>\n\n\n\n<p>Uluslararas\u0131 hukuk da ayn\u0131 do\u011frultuda s\u0131n\u0131rlar \u00e7izer. Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin 10. maddesi ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc g\u00fcvence alt\u0131na almakla birlikte, ayn\u0131 maddenin ikinci f\u0131kras\u0131nda bu \u00f6zg\u00fcrl\u00fc\u011f\u00fcn \u201cmilli g\u00fcvenli\u011fin, kamu g\u00fcvenli\u011finin, kamu d\u00fczeninin korunmas\u0131\u201d amac\u0131yla s\u0131n\u0131rland\u0131r\u0131labilece\u011fini \u00f6ng\u00f6r\u00fcr. Avrupa \u0130nsan Haklar\u0131 Mahkemesi\u2019nin i\u00e7tihatlar\u0131 bu konuda yol g\u00f6stericidir.<\/p>\n\n\n\n<p>\u00d6rne\u011fin, Handyside\/Birle\u015fik Krall\u0131k (1976) karar\u0131nda Mahkeme, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc demokratik toplumun temel ta\u015f\u0131 olarak kabul etmi\u015f; fakat bu \u00f6zg\u00fcrl\u00fc\u011f\u00fcn \u201csorumluluklar ve y\u00fck\u00fcml\u00fcl\u00fckler i\u00e7erdi\u011fini\u201d vurgulam\u0131\u015ft\u0131r. Yani ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc s\u0131n\u0131rs\u0131z de\u011fildir. Yine Zana\/T\u00fcrkiye (1997) karar\u0131nda, bir belediye ba\u015fkan\u0131n\u0131n ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fc destekleyen a\u00e7\u0131klamalar\u0131 \u201cifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc\u201d kapsam\u0131nda g\u00f6r\u00fclmemi\u015f, kamu d\u00fczenine a\u00e7\u0131k tehdit olarak de\u011ferlendirilmi\u015ftir. Benzer \u015fekilde \u015eahin Alpay\/T\u00fcrkiye (2018) ve Mehmet Altan\/T\u00fcrkiye (2018) davalar\u0131nda A\u0130HM, uzun tutukluluklar\u0131 ele\u015ftirmi\u015f ancak kamu g\u00fcvenli\u011fi ve demokratik d\u00fczenin korunmas\u0131 amac\u0131yla belli s\u0131n\u0131rland\u0131rmalar\u0131n me\u015fru olabilece\u011fini kabul etmi\u015ftir.<\/p>\n\n\n\n<p>Bu kararlar g\u00f6stermektedir ki, tutuklu bir ki\u015finin \u00f6zellikle de siyaset\u00e7i konumundaysa sosyal medya \u00fczerinden propaganda yapmaya devam etmesi, salt bireysel bir hak meselesi de\u011fildir; toplumun g\u00fcvenli\u011fi, demokratik d\u00fczenin i\u015fleyi\u015fi ve yarg\u0131n\u0131n etkinli\u011fi a\u00e7\u0131s\u0131ndan do\u011frudan bir risk unsurudur. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc mutlak bir dokunulmazl\u0131k de\u011fil, sorumlulukla dengelenmesi gereken bir hakt\u0131r.<\/p>\n\n\n\n<p>Ger\u00e7ek mesele, \u00f6zg\u00fcrl\u00fc\u011f\u00fc kutsal bir dokunulmazl\u0131k olarak g\u00f6r\u00fcp devletin g\u00fcvenlik reflekslerini fel\u00e7 etmek de\u011fil, \u00f6zg\u00fcrl\u00fck ile sorumluluk aras\u0131ndaki dengeyi kurabilmektir. E\u011fer bir ki\u015fi su\u00e7 isnad\u0131yla tutuklanm\u0131\u015fsa, bunun do\u011fal sonucu onun sadece fiziki \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden de\u011fil, dijital n\u00fcfuz ara\u00e7lar\u0131ndan da mahrum b\u0131rak\u0131lmas\u0131d\u0131r. Nas\u0131l ki fiziki d\u00fcnyada tutuklunun d\u0131\u015far\u0131yla temas\u0131na s\u0131n\u0131rlama getiriliyorsa, dijital d\u00fcnyada da ayn\u0131 mant\u0131k i\u015fletilmelidir. Bunun i\u00e7in Ceza Muhakemesi Kanunu\u2019na ek d\u00fczenlemeler yap\u0131larak, tutuklu \u015fah\u0131slar\u0131n sosyal medya hesaplar\u0131n\u0131n kullan\u0131m\u0131na yarg\u0131 karar\u0131yla k\u0131s\u0131tlama getirilmesi m\u00fcmk\u00fcnd\u00fcr.
