Ancak, aradan ge\u00e7en yakla\u015f\u0131k y\u00fcz y\u0131l sonra, bireysel \u00f6zg\u00fcrl\u00fcklerin ve \u00e7e\u015fitlili\u011fin \u00f6n planda oldu\u011fu bir d\u00fcnyada, giyim ku\u015fam gibi ki\u015fisel bir tercihin kanunlarla d\u00fczenleniyor olmas\u0131, modern bir hukuk devleti anlay\u0131\u015f\u0131yla ne kadar ba\u011fda\u015f\u0131r sorusunu ak\u0131llara getirmektedir.<\/p>\n\n\n\n<p>Anayasal g\u00fcvence alt\u0131na al\u0131nan ink\u0131lap kanunlar\u0131, T\u00fcrkiye Cumhuriyeti&#8217;nin temel niteliklerini ve devrimci kazan\u0131mlar\u0131n\u0131 koruma amac\u0131 ta\u015f\u0131r.<\/p>\n\n\n\n<p>Bu, \u015f\u00fcphesiz ki devletin bekas\u0131 i\u00e7in hayati bir \u00f6nem arz etmektedir. Yeni anayasaya bu \u00fclkenin acilen ihtiyac\u0131 var&#8221; serzeni\u015fi, asl\u0131nda sadece fes meselesine de\u011fil, \u00e7ok daha geni\u015f bir spektrumdaki \u00f6zg\u00fcrl\u00fckler ve haklar tart\u0131\u015fmas\u0131na i\u015faret etmektedir.<\/p>\n\n\n\n<p>T\u00fcrkiye&#8217;nin mevcut anayasal yap\u0131s\u0131, ge\u00e7mi\u015fin miras\u0131n\u0131 ta\u015f\u0131rken, g\u00fcn\u00fcm\u00fcz\u00fcn ve gelece\u011fin ihtiya\u00e7lar\u0131na ne kadar cevap verebiliyor? Bireysel \u00f6zg\u00fcrl\u00fckler, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc, toplanma ve dernek kurma \u00f6zg\u00fcrl\u00fckleri gibi temel haklar, uluslararas\u0131 standartlarda ve \u00e7a\u011fda\u015f normlarda yeniden ele al\u0131nmay\u0131 beklemektedir.<\/p>\n\n\n\n<p>Yeni bir anayasa ihtiyac\u0131, bir &#8220;devrim kanunu&#8221;nun \u00f6tesinde, \u00f6zg\u00fcrl\u00fcklerin kapsam\u0131n\u0131 geni\u015fleten, bireyin tercihlerine sayg\u0131 duyan ve devletin m\u00fcdahale alan\u0131n\u0131 \u00e7a\u011fda\u015f demokratik ilkelerle s\u0131n\u0131rlayan bir yakla\u015f\u0131m\u0131 benimsemelidir.<\/p>\n\n\n\n<p>Giyim ku\u015fam gibi ki\u015fisel ve sembolik tercihlerde dahi devletin belirleyici rol\u00fcn\u00fcn sorgulanmas\u0131, asl\u0131nda daha derin bir \u00f6zg\u00fcrl\u00fck aray\u0131\u015f\u0131n\u0131n tezah\u00fcr\u00fcd\u00fcr.
